How Via Immigration collects, uses, stores and protects your personal information.

About this statement

This Privacy Statement describes how Via Immigration Limited manages personal information. We are committed to protecting your privacy and ensuring that your personal information is handled in a secure and responsible manner in accordance with the New Zealand Privacy Act 2020 and other applicable privacy laws.

Who we are

Via Immigration Limited is a New Zealand based immigration consultancy. Our Licensed Immigration Adviser provides professional advice and representation for visa applications and other immigration-related matters. References in this statement to 'we', 'us' or 'our' refer to Via Immigration Limited.

Personal information we collect

We collect only the personal information reasonably necessary to review an enquiry, provide agreed immigration services and meet our professional obligations. Depending on your interaction with us, this may include your name and contact details, preferred contact method, visa status, immigration history, important dates, identity and passport information, travel, employment, education, family, health, character and financial information, and relevant documents or correspondence.

We may also collect payment and transaction information, information about other people involved in your matter, and technical website information such as your IP address, browser, device and pages viewed.

For an initial Complex Matters enquiry, we do not ask for your residential address or a full copy of your passport. Providing information is voluntary, but we may be unable to assess or respond to your enquiry without sufficient details.

How we collect information

We usually collect personal information directly from you when you submit a website form, contact us, book or attend a consultation, or provide information and documents.

With your authority, or where it is otherwise lawful and reasonably necessary, we may also collect information from your representative or support person, family member, employer, education provider, previous adviser, Immigration New Zealand, another government agency or a publicly available source.

Where required by the Privacy Act 2020, we will take reasonable steps to ensure you are made aware when personal information has been collected from another source.

Why we use information

We use personal information to review and respond to enquiries, contact you using an appropriate method, identify important dates or conflicts of interest, assess whether we may be able to assist, provide agreed immigration advice and services, obtain professional supervision, maintain client and business records, and comply with our legal and professional obligations.

Where you instruct and authorise us to act, we may also use relevant information to prepare and submit applications, requests, appeals, correspondence or supporting documents and to communicate with Immigration New Zealand, the Immigration and Protection Tribunal or another relevant person or authority.

Confidentiality and disclosure

We treat personal information provided to us as confidential and do not sell it. Access is limited to authorised people who reasonably require the information to handle, administer or professionally supervise your enquiry or matter.

Information may be disclosed to Prith’s Primary Supervisor and, where appropriate, Secondary Supervisor to the extent reasonably necessary for supervision. It may also be disclosed to a person you authorise, a service provider supporting our work, Immigration New Zealand or another relevant authority where you instruct us to act, or where disclosure is otherwise authorised or required by law. Both supervisors are required to preserve client confidentiality.

Contacting Via Immigration does not itself notify Immigration New Zealand. We do not provide your enquiry to Immigration New Zealand merely because you have contacted us.

Website systems and overseas processing

Via Immigration uses carefully selected service providers to operate our website and manage professional work. Wix is used for website hosting, online forms and bookings. AdviserAide is used for client and case management, including the storage of client records, documents and correspondence.

AdviserAide states that its primary Microsoft Azure infrastructure and secondary Amazon Web Services infrastructure are hosted in Australia. It also states that customer content is treated as confidential, is not sold, and is not used for purposes unrelated to providing its service.

Some service providers may store or process information outside New Zealand. Where Via Immigration discloses personal information overseas, we will take the reasonable steps required by the Privacy Act 2020 to ensure that it is protected by comparable safeguards, or rely on another basis permitted by law.

Security and retention

Via Immigration takes reasonable steps to protect personal information against loss, unauthorised access, use, modification or disclosure. These steps include limiting access to authorised people, using appropriate account permissions and passwords, and using professional systems with documented security controls.

AdviserAide states that it maintains SOC 2 compliance with independent third-party oversight. Its published controls include TLS 1.2 or higher encryption for data in transit, AES‑256 encryption for stored data, production-access logging, organisational data isolation, security monitoring and encrypted backups. These are security controls operated by AdviserAide and do not mean that Via Immigration itself is SOC 2 certified.

If you become a client, we must retain your client file for at least seven years after the file is closed. Records may be kept longer where required or authorised by law or where another lawful retention purpose applies. Enquiry information that does not become part of a client file will be retained only for as long as reasonably necessary and will then be securely deleted or anonymised.

Access and correction

You may ask us to provide access to personal information we hold about you or to correct information you believe is inaccurate, incomplete or misleading. We may need to verify your identity before responding.

In some circumstances, the Privacy Act 2020 permits or requires information to be withheld. If that applies, we will explain the reason where the law allows us to do so.

Cookies and analytics

Our Wix website uses essential cookies and similar technologies to provide security and support functions such as online forms and bookings. Depending on the features and integrations enabled, non-essential cookies and analytics may also collect information such as your IP address, device and browser information, pages viewed, and how you interact with the website.
